These Terms of Sale together with our website terms and conditions govern our relationship with you in relation to this website and your purchase of product(s) from the website.
We are Khol Cosmetics Limited (in Liquidation) trading as Fuschia Make-up, Scotch Hall, Drogheda, Co. Louth, a company registered in Ireland, Registered Number: 404843, Telephone Number 041 9839823 (“Fuschia” “we” “us” “our”).
LIQUIDATION OF FUSCHIA
On 6 August 2020 Fuschia went into a creditors' voluntary liquidation pursuant to a resolution proposed and passed by its shareholders and Mr Shane McCarthy of 1 Stokes Place, St Stephen's Green, Dublin 2 was appointed as liquidator (the "Liquidator") to it.
EXCLUSION OF LIQUIDATOR'S LIABILITY
The Liquidator shall not incur any personal liability of any kind under these Terms of Sale or any sale executed by the use of this website or any other agreement made in connection to it whether or not such agreement so provides and the Liquidator shall not incur any personal liability of any kind in relation to any other related matter or claim, whether in contract or in tort (including negligence or otherwise) or by reference to any other remedy or right in any jurisdiction or forum.
No representation, warranty or condition, express or implied, is given by or on behalf of the Liquidator or Fuschia, its officers, employees or agents in respect of the use of the website, the website's content or any agreement made in connection to it.

Please note that before placing an order with us (“Order”), you will be asked to agree to these Terms of Sale by ticking a box just before you checkout. Please understand that if you refuse to accept these Terms of Sale, you will not be able to order from our website.
We endeavour to ensure all details (including prices) displayed on this website are correct and up to date. However, we have a large number of products on our website and sometimes products may be incorrectly priced.
You must ensure that prior to placing an Order, you have checked all relevant details about the products you have selected as their relevant details may have changed since you last visited this website. We will ensure that the products conform with the Order. Product prices shown on the website may change from time to time.
Please note if a pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the relevant products to you at the incorrect (lower) price.
ITEMS NOT IN STOCK
In light of Fuschia's liquidation, Fuschia, as it relates to products online can only supply: (i) end of catalogue products; (ii) clearance products and (iii) surplus end of range products to users of this website and all of our products are sold as seen as per the specification on the website. Once materials are sold, they will not be restocked by Fuschia.
All products displayed on this website are subject to availability and all orders are subject to acceptance.
All Orders are clearance and final sales in light of Fuschia's liquidation. In the event that you have ordered and paid for an item that is out of stock, our team will contact you to discuss how to proceed. At this point we can either recommend a similar product subject to stock availability or we will refund all monies within 5 - 10 working days. Fuschia is not liable for any costs arising from the refund.
All prices are inclusive of VAT (but do not include delivery charges which will be added to your total prior to you placing your Order).
Your payment card or Paypal account will be debited on acceptance of the Order.
Orders are submitted via the website in the following way:
- Once you submit your Order, we will usually then send you a confirmation email to acknowledge that we have received your Order and that your Order has been accepted by us. At this point the contract between us is formed and we will process the payment details you have given to us to take payment for your Order.
- You should check the confirmation email for accuracy and let us know immediately if there are any errors.
- When you submit your Order, you are offering to buy the product(s) at the price set out in the Order. Prices are checked regularly. However, if we find the price has changed, or that there has been a pricing error when we receive your Order, we will contact you and ask if you wish to proceed at the correct price.

CANCELLATIONS & RETURNS
You have the right to cancel your Order within 14 days of receipt of the Order. We are happy to offer a full refund on all cancelled Orders (unused and in their original packaging) that are returned to us within 14 days of receipt of the Order. If you wish to cancel any Order please contact our customer services team at IE-FMkholcosmetics@kpmg.ie within 14 days’ of receipt of the Order and we will be happy to assist you. Please note that we will not be responsible for the cost associated with the return of any Order.
Please allow up to 5 working days after we receive the goods for the refund to be credited to your bank account.
If you receive the Products in less than perfect condition then please alert us within 48 hours of identifying the fault at IE-FMkholcosmetics@kpmg.ie.
Please make sure to write your name and order number on the returned package. We reserve the right to determine, at our absolute discretion, whether the products are faulty. Subject to confirmation by us of the fault, we will be happy to offer a full refund on all faulty products including the costs of returning the faulty products.
It is not currently possible to exchange an item on our website.
